Understanding the Pennsylvania Real Estate Mediation Process

What Is Real Estate Mediation?

Mediation is a confidential process in which a neutral third party, the mediator, guides both sides through a structured conversation. The goal is to surface the real issues, explore what a workable outcome looks like for both parties, and reach an agreement that is reduced to writing and is enforceable. Unlike a judge or arbitrator, the mediator does not make decisions for you. Any agreement reached is one both parties chose to make.

At Real Estate Mediation Service, that process is applied exclusively to real estate disputes. Our mediators bring decades of real estate case experience, an understanding of what drives these disputes, and the interpersonal skills to move people forward even when the situation feels hopeless.

Confidential

Everything said in mediation stays in mediation. No public record, no court transcript.

Neutral

Your mediator does not take sides, assign fault, or decide who is right. Both parties are heard equally.

Your Decision

No outcome is imposed on you. Both parties remain in control and choose whether to reach an agreement.

What Are the Benefits of Real Estate Mediation?

Mediation Benefit #1: Private: Your Dispute Stays Out of the Public Record

Court proceedings create permanent public records. Mediation does not. Everything discussed in your sessions remains confidential and cannot be used against you in subsequent litigation. Whether your dispute involves undisclosed defects, a failed closing, or a contested hand money deposit, sensitive details stay between the parties as part of the mediation process.

Mediation Benefit #2: Impartial: No Sides, No Agenda

Your mediator has no stake in the outcome and no relationship with either party. Each side is heard. Each position is discussed and information exchanged. The process moves forward only when both parties are ready.

Mediation Benefit #3: More Control Over the Outcome

Mediation gives the parties a direct role in shaping the resolution. Unlike litigation, where a judge or jury decides the outcome, mediation allows the people involved to work toward terms they can both understand and accept.

Mediation Benefit #4: Control: Agreements Built Around Your Situation

A mediator’s role is to help you build an agreement that reflects your actual circumstances. In real estate disputes, that might mean a structured payment plan, negotiated repairs, a new timeline for a closing, or any other solution that fits the parties needs.   You can be creative with your solutions at the mediation table, unlike in a courtroom where a judge or jury makes the decisions for you.

Mediation Benefit #5: Cost: A Fraction of What Litigation Costs

Real estate litigation is expensive. Attorney fees and costs of litigation can rise quickly. A successful resolution at mediation can end those costs and fees and bring closure to the parties in a lawsuit.

Mediation Benefit #6: Speed: Most Real Estate Mediations Resolve in a Single Session

While civil litigation can stretch across months or years, most real estate mediations conclude in one session. There are no court dates to schedule around, no prolonged discovery processes, and no waiting to make it onto a trial list. When a buyer-seller dispute or contract disagreement reaches mediation, resolution typically follows quickly.

REMS' Philosophy

The focus is on resolution, not fault.

Rather than arguing over who is right, the session is structured around identifying the core issues in the dispute and exploring practical agreements that work for both sides.

Have Questions About Your Real Estate Dispute?

Our Approach to Mediation

The Benefits of Mediation Are Only as Good as the Mediator Delivering Them

Everything above, confidentiality, control, speed, cost savings: these are real. But they depend on a mediator who knows how to create the conditions for them. A generalist working their third real estate case this year cannot read a dispute the same way a specialist who has seen hundreds of them can.

Real Estate Mediation Service is the only practice in Western Pennsylvania built exclusively around real estate disputes. Our mediators bring decades of combined real estate mediation experience, deep familiarity with Pennsylvania contract law, and the judgment that only comes from handling these specific cases, day after day, year after year.

What Happens During the Real Estate Mediation Process?

Step 1: Getting Started

  • Participation is voluntary. The mediator confirms that all parties are choosing to proceed. No one is compelled to continue at any stage.

  • Representation is welcome. You may bring an attorney or other support person. Let the mediator know in advance who will be attending.

  • Questions are welcome before you begin. Your mediator will contact both parties ahead of the session to explain what to expect and answer any questions.

Step 2: Your Mediation Session

  • Everything stays confidential. Nothing discussed during the session can be used against you in subsequent court proceedings.

  • Each party is heard. Every participant has the opportunity to present their perspective. The mediator ensures the conversation remains balanced and productive.

  • Private sessions are available. Either party can request a caucus, a private one-on-one conversation with the mediator, to discuss sensitive aspects of the dispute confidentially.

Step 3: Reaching an Agreement

  • Most real estate mediations conclude in a single session. There are no court dates to schedule around, no prolonged discovery, and no waiting for a docket slot. You could walk away with a binding agreement the same day.

  • Agreements are documented. When the parties reach an agreement, the mediator drafts a Mediation Agreement that sets out the agreed terms. This reflects the decisions made by the parties, not a judgment handed down by a third party.

  • Your legal rights remain intact. If no agreement is reached, you are free to pursue other options. Starting mediation does not close any doors.
